2. Terms of Use (ToU)

2.1. Purpose

These Terms of Use govern access to and use of the WishyfAI application available at wishyfai.com.

2.2. Access to the Service

Using the service requires creating an user account.

WishyfAI may suspend or terminate an account in case of abusive, fraudulent or non-compliant use.

2.3. Service Description

WishyfAI allows users to:

use multiple AI agents,

create custom agents,

upload documents, notes and messages,

receive AI-generated analyses, exchanges and recommendations.

Limitation: WishyfAI does not provide legal, financial, medical or regulatory advice.

2.4. Availability

The service is available 24/7.

Interruptions may occur without prior notice (maintenance, updates, hosting issues, force majeure).

WishyfAI cannot be held liable for any consequences arising from service interruptions.

2.5. User Content

Users remain the owners of the content they upload.

Users guarantee that their content does not infringe third-party rights.

2.6. Security & Data

WishyfAI implements technical and organizational measures to protect user data.

For users subscribed to a paid plan, personal data and submitted content (use cases, documents, messages, analyses) are never used to train or fine-tune our AI models.

They are processed solely to operate the service and ensure the quality of generated analyses.

For Free plan users, certain aggregated and anonymized technical data may be used to improve models and features, without any possibility of personal identification.

2.7. Limitation of Liability

WishyfAI cannot be held liable for:

decisions made by the user,

the use of AI-generated analyses,

indirect damages or losses related to the use of the service.

2.8. Account Deletion

The user may delete their account at any time from their personal dashboard.

2.9. Changes to the ToU

WishyfAI may update these Terms of Use.

The version applicable is the one published on the website.

3. Terms of Sale (ToS)
(Applicable to paid subscription plans)

3.1. Plans & Pricing

Prices for the Free, Access and Premium plans are displayed in USD.

WishyfAI may update pricing, except for an ongoing billing period.

3.2. Payment

Payments for WishyfAI subscriptions are processed via Airwallex, a certified and secure payment service provider.

WishyfAI does not store any banking or payment information.

Airwallex provides:

international payment processing,

optimized multi-currency conversion,

PCI-DSS compliance,

secure transaction and data protection.

3.3. Renewal & Cancellation

WishyfAI subscriptions are billed monthly or yearly, depending on the option selected at purchase.
Each subscription renews automatically at the end of its billing period.

The user may cancel their subscription at any time from their personal account.
Cancellation becomes effective at the end of the current billing period (month or year).
Access to the service continues until that date.

No refunds are provided for billing periods already started—whether monthly or annual.
Cancellation does not entitle the user to prorated refunds or credits for unused time.

3.4. Refunds

Unless required by law, fees paid are non-refundable.

3.5. Premium Features

Paid plans may include:

3.6. Liability

WishyfAI does not guarantee specific results but provides a decision-support tool.

For Free plan users, aggregated and anonymized technical data may be used to improve our models and features, without enabling personal identification.

All processing is carried out in compliance with GDPR.

To operate the service, WishyfAI may rely on subcontractors compliant with GDPR.

AI model providers (LLM providers) – To process content submitted by users
Depending on performance needs, WishyfAI may use:
OpenAI, Google Gemini, Anthropic, Mistral, xAI (Grok), or equivalent providers

Analytics tools (e.g., Wix Analytics, Google Analytics, Amplitude, Mixpanel) –
Used to measure audience and enhance product experience

All subcontractors are bound by contractual obligations ensuring adequate security, confidentiality and data protection levels.

4.8. User Rights
